The article presents those regulations, (either in place or included in the draft public finance act), concerning borrowing by local government, which, in author's opinion, have the biggest influence on the possibility of borrowing by local government on the capital market. The aim of the article is the comparison of the present to planned regulations, their evaluation, and the explanation of the main restrictions in the local government borrowing system as well as the formulation of concrete proposals for solutions eliminating determined problems.
