The article presents problems involved in the establishment of economic legislation, in particular in the registration and recording as well as in regulation of business activity. The subject of comparison is the Business Activity Law in force since 2001 and the Business Freedom Act along with its introductory act, that has recently been adopted by the Sejm.

Comparing the repealed act with the replacing act leads to a conclusion that an opportunity of comprehensive and complex regulation of this important domain has been lost. The two separate systems of registration of entrepreneurs shall still be applied: the National Court Register, covering commercial law companies and the Register of Business Activity, covering natural persons, the latter independent from the former. Red tape in registering entrepreneurs - natural persons will increase, since each entry into the register and any modification hereto will be raised to the rank of an administrative decision. Authorisations and licences to carry business activity will be rather artificially divided into those, which are enumerated in the Act and those which are not. The general principles of granting authorisations stipulated in the repealed Law will also cease to be binding. There will not be an essential change of the number of required authorisations. Only 32 kinds of authorisations shall be converted into entries into the register of regulated activity. Posting such an entry does not differ much from the procedure of obtaining an authorisation. Among the achievements of the new Act is the establishment of general rules for conducting examinations, even though they contain a large number of exclusions.
