Adam Zych Payment delays in public orders
One of major irregularities existing nowadays in public orders are substantial, in many cases, delays in meeting payment obligations for supplies and services by the government units.
According to the author, local government entities are most unreliable payers in the area of public orders.
Amongst extremely complex reasons recognized in public orders, i.e. payment delays resulting in payment delays, the author focuses in particular on crucial weaknesses of the existing Act on public orders. Namely, the Act does not impose on the mandator an obligation to set planned payment date just at the tender stage. Some government units apply this with utmost severity: they place orders despite the lack of appropriate financial security. Therefore, the Act on public orders requires relevant amendments.
